Legal references (EU)
- Dir 2011/83/EU Art. 9
Some guidelines reference legal provisions. These references identify the rules a guideline relates to. They are not legal advice, they are not a statement that any particular shop complies or does not comply, and they may not reflect the current state of national transposition. Consult qualified counsel for questions about your own compliance.
What is being checked
Whether the shop states, with real dates, until when holiday purchases can be returned, and whether it explains how the person who received a gift can exchange or return it.
Why it matters
Gifts are bought weeks before they are opened. A normal return period that starts at delivery may be over before Christmas Eve. Many shops extend the return period for this reason, but only say "extended returns", which leaves the buyer to guess what that means for their order.
The person who receives the gift has a different problem: they did not order it, do not have the order number, and do not want to ask the giver. Explaining how a gift exchange works removes the giver's fear of buying the wrong size or colour.
Failure signals
- The shop mentions "extended returns" without dates.
- The extended period is only in the terms and conditions, not on the product page or in checkout.
- Different pages state different return dates.
- There is no information on how a gift recipient can exchange or return an item.
- The extension is worded in a way that suggests it replaces the legal right of withdrawal.
How to verify
- Look for the holiday return terms on a product page, in the cart and in checkout.
- Confirm they state a date ("orders from 1 November can be returned until 15 January"), not only "extended".
- Confirm the date is the same on every page and in the order confirmation.
- Look for instructions for gift recipients. Confirm they can start an exchange or return without the buyer's login.
- Confirm the text keeps the extended shop return period separate from the legal right of withdrawal. See PDP-DC-RETURNS-01.
Recommended fix
Decide on a fixed holiday return date, for example 15 January for all orders from November on. Show it with the return information on the product page, in checkout and in the confirmation email. Add a short "Returning a gift" section that works with a gift receipt or the order number, without needing the buyer's account.
